On Friday, Feb. 27, Peterson Media Group filed two open records requests with the City of Tullahoma regarding the Board of Mayor and Aldermen’s decision to accept former City Administrator Jason Quick’s resignation.
Quick’s resignation was accepted along with terms of a settlement agreement on Thursday, Feb. 26. Find that story here.
Alderman Matthew Bird said in the BOMA meeting on Feb. 26 that the BOMA had been provided with the results of an “independent legal investigation” that led the BOMA to believe that accepting Quick’s resignation was in the best interest of the city.
On Friday, Feb. 27, Peterson Media Group made an open records request for the results of the investigation referenced by Bird.
“There is no ‘legal report’ or document to provide,” City Attorney Brittany Hoskins said in response.
Peterson Media Group then expanded its request to include statements from city employees, department heads, or others related to Jason Quick’s job performance; all documents related to the city’s decision to accept Quick’s resignation and the terms related to that resignation; and all documents related to the city’s concern about Quick’s job performance.
Hoskins replied with the following email:
“We cannot produce documents that do not exist. There are no written statements from employees, department heads, or others related to Mr. Quick’s job performance. There are not documents related to the City’s decision to accept his resignation or related to the City’s concern. Once a settlement agreement is signed and becomes a City document, it will be subject to the Open Records Act, and that is expected next week.”
In a call with Peterson Media Group, Hoskins said “everything was done orally,” which was why no written documentation existed. She said that she expected the settlement agreement to be available through an open records request on Wednesday, March 4. She said that due to certain confidentiality agreements, this was all the information she could provide and said the settlement agreement would provide more answers as to why the city did not have written documentation to provide in response to Peterson Media Group’s requests.
Peterson Media Group also reached out to Quick for comment. Quick declined to comment, saying he was under a non-disclosure agreement.
